Lake Charles, Louisiana – At around 3:00 a.m. on July 27, deputies from the Calcasieu Parish Sheriff’s Office were sent to a nearby hospital in Lake Charles, Louisiana regarding a minor girl, under the age of 13, who had recently delivered a baby.
At the beginning of the investigation, detectives interviewed the victim, who reported that Jose L. Montoya, a 39-year-old from Lake Charles, Louisiana, had engaged in sexual activity with her on multiple occasions over the previous two years. Montoya verified the accusations when questioned by detectives. He also informed the detectives that it was probable that the newborn was his offspring.
Montoya was taken into custody and brought to the Calcasieu Correctional Center where he was formally charged with two counts of first-degree rape. His bond has not yet been set. Detective Larry Cormier from

An arrest is an indication that probable cause exists to believe the subject was involved in the offense alleged. All persons are presumed innocent until proven guilty.
